Actually it was the 50th anniversary of the signing of the Civil Rights act that brought this home… The Civil Rights Act among many other things enforced the role a Federal Government should have over the national character. Prior, if the South behaved in one way, that was acceptable. If the North behaved in another, that was acceptable…
The Civil Rights Act stated that some behaviors are indeed deemed not acceptable. It dealt with opposing local laws, opposing local enforcements of segregation, and opposing individual business practices perpetuated by the wishes of small handfuls of individual business owners who like Hobby Lobbyists, thought they could do what they liked….
The Civil Rights Act in no uncertain terms, said: No! We are a nation of principles embodied in our Constitution as well as our Declaration of Independence, and you cannot violate those principles in the name of “your” personal freedom….
Hobby Lobby sort of changes all that… The big fear is that it just opened a door so that corporations can freely do whatever they feel is best, and that any legislation voted and signed, now has no real impact upon them because they are after all: … corporations…. You have all read the slippery slope theories and so I won’t redo them. But slippery slopes have a tendency to sometimes be idle warnings…. A lot of people walk on slippery slopes; very few fall off… In part that may be due to warnings from others that they are on slippery slopes and to be be careful… Just like a road sign of a car with skid marks makes one say, “oh yeah, that’s right, it’s raining, I’d better take this curve slower.” and possibly affect the outcome of that turn….
But slippery slope or not, the Hobby Lobby decision does do this: it says that what a government says you have to do, you don’t have to do, provided you can find a reason that is valid for you not doing so…
And that is rather Libertarian.
It makes one sigh that history is a lost art. Because there were times in our history when Libertarianism indeed was the predominant philosophy…. So why was there never a Libertarian Party? After all, one would think that a dominant philosophy would have a Libertarian Party, correct?
How soon we forget….. The reason there was no libertarian party formed to compete against other parties is because during this time of Libertarianism, there was no structure of Government requiring organized parties…. Of course I am referring to the times under the Articles of Confederation…. When the idealism of throwing off the king of England, made the predominant meme that one of “not taking on a new authority to replace the role of the other”….
The reason we don’t have a Libertarian run government today, is because the reality turned out to be that it could not work. It’s own beliefs worked against its own existence… How can you have an effective government telling you what to do when your government was founded on its not being able to tell you what to do?….
So, America’s top citizens at that time scrapped the Confederation, established a Constitution, and today, we are still here…. Debating Libertarianism rampant in today’s court….
Just looking over the final stats, I did see that the percentage of cases in which this Supreme Court decided things 5-4 were only 13%. Yet, its 9-0 decisions marked 65% of this year’s final tally. So it is with a grain of salt that we should dismiss the entire court… In doing so we fail to see the wisdom behind having the third branch of government… It allows for the last look.
This year the average age of the Supreme Court is 68…. it’s average composite would have been born in 1946… would have gone through grade school in the 50’s while segregation was perfectly legal, would have been a high school senior the year Kennedy was shot, college would have structured by the military-industrial complex, being too soon they would have missed out on the protests of ’68 onward, would think Jersey Boys were the ultimate musical group ever, would never try drugs, would have been disappointed in the 70’s as that decade’s media ridiculed all the structure with which they grew up and made them iconoclasts inside their own world, would always fondly remember Mom at home and Dad always working to the bone, would be in their late 30’s when Reagan came into in office, and see in his grandfather qualities the fondness of the times they grew up, would be 45 when the Soviet Union imploded, 57 when we invaded Iraq, 62 when the Global Depression hit, and now stand at the cusp of 68…

In some cultures, a grandparent. Who ironically, when that president was sworn in, the number one single was “Imagine”…..

So to say the Supreme Court is representative of all of America is bolderdash… Nothing could be further from the truth… But perhaps that was exactly the point in how the Supreme Court came to have as much power as it does, now checking the other two branches?
Originally the Supreme Court was an appendage organ of the Constitution. It’s power was sharpened only 30 years after the Constitution was founded when changes were being made by Congress and the Executive Branch, that woke up the Supreme Court and stirred it into saying,… “Hey, no! That is not what the Constitution meant. We were there! We know…” It was kind of hard to refute that argument back then… If you walked and talked with Washington, Jefferson, Adams, Hamilton, you probably had a better grasp on the Constitution than some thirty year punk still green behind their ears….
It is a global common tendency of youth to dismiss the wisdom of their elders… “You don’t know because you don’t live in our world now”, is a very common expression in most households of teenagers no matter what upbringing those old children have had. I fondly remember my frustration with my own parent’s conservatism, thinking they were incapable of thinking anything different what they had been told to think. My children made me realize otherwise. In fact, once I was seasoned I was surprised to learn that my parents thought they were the rebels dismissing the conservative attitudes their parents had bestowed, and were proud they were the cutting edge of liberal child-raising in their day… Furthermore, in candid discussions with my grandparents, I was quite surprise to hear how they threw out the patterns of THEIR parents and raised their children using the cutting liberalism of child raising in THEIR day… Bottom line, my great grandparents must have been REALLY conservative… And now, according to my children… I’m just like they were….
No one would let a child run a family. No one should let a 30 year old run a business. No one should have a 40 year old run a nation… But we do. Rarely does it work….
Point is: the Supreme Court will always play it’s role… That role is to look at fundamental changes and decide how they stack up to the Constitution… As a periphery example of what could happen without this type of check, just review what happened to our own economy since the Bush tax cuts went into effect. With a new crowd taking over our economy since 2000, dismissing the old tried and true policies, we have seen how destructive new untested fads can be… Imagine if an economic court of New Dealers had been present to say “NO, this is the 1920’s all over?” Our national debt could be zero now. The same is true in government. Were Congress to become completely bought out, and sell our votes for arbitration, and there were no check? The end of the world as we know it.
Will old geezers always be right? No.
But if they are wrong, natural forces congeal and work harder to overturn the well-intentioned but error-filled decisions. Slavery took a war. Segregation took television beatings of a proud race to show us that intimidation would not work; beatings wouldn’t stop “being right” from moving forward.
But if the geezers are right, it stops bad right then and there….
Not to absolve the Supreme Court but their primary function isn’t to distinguish between “right” or “wrong”. Their job specifically, is to see how our system of laws stacks up to our Constitution… by looking at one challenged law at a time. Sometimes when they do, it comes up right…. and sometimes when they do, it doesn’t….
If you think the Court was wrong, and if you think it is out of touch, YOU HAVE AN OBLIGATION to vote Democratic in 2014, and to express to all others, both Republican and Democrat the importance of THEIR voting democratic as well in 2014 to send this signal, and we will see, just how wrong this court is…. If you can’t get out the vote… then gee, maybe the court was right after all.
Which… as the framers of the Constitution intended, in the end, puts us, the American people…. firmly in charge of our government….
Across our landscape there are very few pivotal landslide elections. When they happen they create a new dominant party for a long time…
I can only think of four… FDR’s first two terms and Ronald Reagan’s two terms. Both set in motion a new philosophy and new institutions to enforce the continuation of that policy long after their respective deaths…
(Clinton’s 2nd term would almost qualify but its effect was squandered on Monica Lewinsky… Doubt that? And you just told me you are not from the South, Great Plains, or the mountainous West.) ..

A nice span of 68 years… The philosophy espoused by those in the heavily red maps, overlaps a little, but most would say it is the primary driver of most policy today, which give it a lifetime stretching from 1981 to today… A lifespan so far of 33 years…

2014 will be a pivotal year for several reasons.
A) There is no cap on how much can be spent.
B) Voter turnout is consistently low. So advertising will be the worst ever, meaning every vote that switches carries more weight. Every voter who gives up in disgust, and does not vote, gives up that much more of a percentage on deciding the total vote…
C) Wealth will outspend the poor this year. Wealth has the money; 80% of the population is unable to write a check to either political party….
D) Both parties’ policies are streamlined into clear agendas. One party (with money) is for policies that help the 1% do better and pay for them by hurting the 99%… The other party is for policies that help the 99% do better, and pays for them by hurting the top 1%….
E) Because of the politics of doing business, all those media outlets in charge of telling you the news and sometimes the truth, cannot in good conscious, tell you the truth anymore… They simply can’t risk getting pushed off the buying spree…..
You have to choose who to help: the rich or poor, and you have to vote, no matter what obstacles they throw up in your way…. you must remember that those obstacles are there for a reason, and will remain there until we get either an all blue, or all red America showing up in Wikipedia on election day.. Because those obstacles are there solely to protect the losing parties advantage in an effort to keep America from going all blue…
This raising of the cap also means, that if you are a CEO planning an ad campaign that will be kicking off from late August through a holiday December… your ads won’t register with audiences until the day after election… Save your advertising money. There is no way you can compete for airtime against someone who will pay any price to get his ad on the air… Save your money…
My personal experience is that over the past two elections, the non political people I know mentally tuned out of ads… Ads no longer work. What does work is the personal connection of talking to real people… There were almost no campaign ad buys in 1932 or 1936. And there were campaign limits on money spent in both 1980 and 1984…. Primarily both those sweeping groups of elections were decided upon word of mouth….
I used to get mad at conservative talk shows, until I realized there were only the same 5 people calling in… Out of 3 million people… Were they shills? I don’t know but their voice prints were consistent. Occasionally someone thinking the talk show was real would call in, but it was rare…
Fight apathy. This is where you come in… If you read this, you probably will look at the ads too… Your job is to interpret the ads to all you know as nothing more than billionaires blowing smoke out of their orifices like they are lavishing in a Bangkok bordello. These ads don’t correspond to real life. People don’t hate their neighbor because they have an Obama or Romney sticker on their care… 99% of us say… “Oh, whatever” .. “Who gives a shit? Hey! Can you tell me where you bought your truck?”
The point is that all those red states are not all red deep inside… There are a lot of blues there too, at least 30% in the most red, and often in populous states, up to 49%…. Human beings living in those states have a lot more clout than some clever ad that simply makes up stuff around a table and then pretends it it true, using actors, and trying to crush the airwaves with massive volume before the fact-checkers get the messages out calling it all bunk..
It is We, The People versus They The Billionaires. It is a game of Monopoly in its final rounds and we only own a monopoly on the yellow squares on the back side… Our only hope left is that we get to shuffle the stack the Chance cards every time we vote… And if you don’t want to go through this all over again in two more years, with more unlimited funding in 2016, you need to make sure that despite $4 billion being spent this mid term election, it does zero good to the Koch’s or anyone else…
If we can get a Blue House, we will have a blue Senate, and we can move forward with a blue president…. it’s almost worth dying for.
It’s all about word of mouth… And be nice… Republicans aren’t bad people anymore than Democrats, and when you talk to them realize you probably look as weird to them, a they do looking right back at you. And trust me, if you read the news and blogs you would already know that the majority of Republicans are looking for something new. They just don’t know what. And should you need a shot of hope? Cast your eye on these electoral maps which are of the elections just before the ones above when the massive tidal waves made their landfall…..
Things can change quickly when everyone individually just gets fed up that things are not going their way… At 99%, the numbers are in our favor…
But it is all about you. Now get out and start talking. Tell the truth… Be nice.
I wonder if we could get 2 million to show up for a march in DC against billionaires buying out our elections? We could, but it would take some work, but that would be a very effective message against an unmatched $4 billion being spent to prevent democracy.
Our message would be real, with real people. Their’s as fake as Mr. Ed….. (that is who David Koch looks like I think; compare the chins)…

For years we have quietly known and accepted the negatives of having an NSA. Things like we need it for our protection, or it makes things safer, tended to overide our fears that they know too much already, and I can’t do anything in private anymore…
We accepted that as progress.
However, when you have an organization so secret, that members of Congress are shocked to find out what it is doing, that no one knows who is authorizing who gets spied upon and what, that when brought before the courts for overstepping the Constitution, it can’t be prosecuted because a) it operates under “secret” laws, b) with “secret operations”, c) authorized by “secret courts” …. it is time to shut the entire operation down.
Why do we have the NSA when we have the CIA and the FBI. The FBI covers domestic spying. The CIA covers international spying. So, unless we find out that there are aliens and the NSA is really running the world while we think otherwise, then it probably ought to go.
I find it interesting that those on the far right, and those on the far left are the most outraged by this disclosure. We’ve been stating that news on this blog after the story was broken back in 2007-8 and not one press person cared. I supposed the AP Story opened their eyes this time. Struggling to put a finger on why, I came up with the theory primarily by looking at Congress, that it is the libertarians on left and right who are against, and the conformist, primarily in the center who are acceptive. So this gives us a split where the bottom third and the top third of the political body are opposed to the middle third… If you look at Congress that is exactly how it splits up. Moderates are pro domestic spying, the libertarians are not.
Probably similar is the theory that those beholden to corporate interests are pro-spying, after all, that is normal in the corporate environment; interoffice spying is not limited by any judicial system because it is deemed to be private. Those aghast, tend to fight corporate intrusion from their original political perspective, either left of right.
What the NSA does, watch everything to discern what is happening to increase its chances of survival, is not new. Intelligence has been the secret success of many an empire. Knowing what someone will do before they do it, is pretty comfortable in a world where in a day, we probably pass within 10 feet of 10,000 people (that includes inside our vehicles).
That is what all governments with the capacity, do. The biggest argument against it, is that it is un-American. Sure we have the “ability” to do it, but do we have the restraint, not to…
America has always been ruled by restraint. When Washington was entreated to be the King, he restrained and said no. When the heads of Europe all bet that Washington would invent a method to stay in power, he restrained, and government turned over peacefully. When the US was left in charge of a broken Europe, it put it back together and went home. The only country to invade another and give it back willingly to its original owners.
We had a scare in Boston a while back. Did the NSA protect us then? It’s a secret, no one knows. In Newtown 26 bodies littered the floor of an elementary school. Did the NSA protect us then? When a gunman burst into Aurora firing into the audience, did the NSA protect us then? When Gabby Gifford took a bullet, where was the NSA? Did the NSA protect us then?
That is the point. We are always in danger. But our personal lives are more at risk if our private information should fall into a competitors hands, than being victim of a terrorist. In Boston just 2 people died. In Newton 26. But each and every one of us, is at risk that selective information from ones past, can be used in secret to smear each and every one of us, should it fall into the wrong hands.
What would happen if we shut the entire agency known as the NSA down? A big nothing. They overstepped. It is not knee-jerking anger to respond “Shut them down right now!” It it calm, cool reasoning tipping the balance, that points out simply that is the right way to go.
A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.
What the NRA is proposing: that every man become his own enforcer of his own view of “constitutionality” by having his own masses of whatever firepower he so chooses, … is the exact opposite of being well regulated. As we see with every new report of shootings, it promotes anarchy.
If we assume that a civilian population is required to keep arms to protect itself from tyranny, then by the words of the Constitution itself,… we have to regulate those very arms…
We can regulate them by banning assault rifles. We can regulate them by banning high capacity clips. We can regulate them by registering every firearm to a single owner, and holding that single owner accountable for whatever accident befalls that gun. We can regulate them by requiring insurance, and if there are those who refuse to abide by the constitutional regulations, we can incarcerate them and be done with them.
The Constitution allows for firearms, only IF THEY ARE WELL REGULATED….
So, in order to validate the Constitution, let’s regulate all firearms….. Failure to do so, is a violation of the Founding Father’s own principles, and is unconstitutional….

Today in order to capitalize upon the fact that the fourth quarter economy sank (even though it was because of the downward pressure due to the threat of sequestration forced upon Congress by the Tea Party), they wheeled out Arthur Laughter Laffer to make a dire predictions….
He is on their short list of who-to-call-when-we(FOX News)-NEED-a-dire-prediction…..
Because….. He is well known for making “dire predictions”..
“Economist Arthur Laffer told his clients on July 26, 1982, that (Ronald Reagan’s) Tax Equity and Fiscal Responsibility Act, which raised taxes by about one percent of GDP, “will stifle economic recovery,” “retard economic growth,” and undercut “the economy’s ability to enter into a period of expansion.” On August 20, 1982, he told his clients that TEFRA, Tax Equity and Fiscal Responsibility Act, “will tend to lengthen and deepen the recession.”
Instead, ….. No one could have been more wrong…

Democrats were in full force, and in New Castle County, not one Democratic sign was left standing… By noon all were stored for safe keeping…
There were no libertarian candidate’s signs. As dedicated citizens, the libertarian team scoured the county and by noon, their signs were all stored for save keeping.
The one Jill Stein sign I’d seen, was gone. Secured by the Green Party….
In fact the only signs up as darkness approached, were those of Alex Pires, which is understandable, it being a one man operation, and those of the Republican line up, which apparently has even fewer supporters.
It looks like Kansas, at intersections now, with only Republicans contesting a one man operation….
If the Green Party and Libertarian party can mobilize faster than the Republican, it is time to stop calling the Republican Party a “major” party.
Even the Wizard of Oz had more going for it than today’s Delaware Republicans, who with their daily bumbles are rapidly creating a new definition of the English word pathetic.

Coupled with the opinion polls, what is happening is very obvious.
Americans support Democratic middle class values, they abhor the wing nuts of the Republican Party.
The opinion polls tell it all. While Romney was campaigning to see who could be the most conservative, he did very poorly against the Democrats when polled. Americans far preferred “the imploders” at first, people more mainstream in appearance, like Rick Perry, Newt Gingrich, Rick Santorium, .. that is until they became familiar with their values…
It is not coincidental, that the last two Republican presidential candidates were the ones with the most LIBERAL credentials. Because America accepts those credentials. What America rejects, is slash and burn Conservative policies, that require no personal freedoms to individual Americans, whether it is economic, vaginal, religious, or political. Everyone is expected to conform to a very narrow norm.
So we now have a Republican who did exactly what he said early during the primaries. He shook the Etch A Sketch and is now running as the Liberal Governor of Massachusetts.
“I will not give a tax break to the top 20%.
There will be no tax cut on the top one percent.
I will not get rid of Roe versus Wade. Abortion is here to stay.
I will not put religion into government. Government is Government. Religion is Religion.
I will not nuke Iran.

I will not stop the removal of God from government….
Homosexual marriage is not really that bad after all, as long as they LOVE each other and it’s not just sex.”
These were all in the debate. It was a different Romney speaking. Why? Because as a conservative he was losing. As a conservative he was out of touch with America. As a conservative HE WAS IN THE MINORITY WITH MINORITY VALUES.
As Conservatives long expected, Romney is a liberal. They know it. Really? How does anyone expect a Mormon to support Pat Robertson and the 700 Club? You do it out of expediency; not a genuine shared system of belief….
But the point of this is not about Romney. It is about Conservatism. Conservatism fails, and simply for that reason alone, it is not upheld by a majority of Americans.
Which means, to win, one has to be a Liberal Republican… Just look at the polls. As soon as the Liberal Romney comes out of the closet, the polls get real tight….
But, as we saw with Bush W. You may run as a Liberal, but when you get in, it’s the Conservatives who take over. Two wars, a pharmacy company bailout, and regular government operation, all which were financed by our grand children’s future payroll deductions. They get to make less money so today’s Republicans can take it all.
In other words, to be a Republican President, you have to “trick” yourself into that position.
So, America, I know it sounds nice now, but over and over and over you have said, no that is not what we want.
What we do want, is someone who will do what we want, when they get into running America. let’s take the last president for example. Obama got us out of a recession in record time. One that was far worse than the Great Depression to some extents. Obama saved the American Automobile Industry. To do so he had to drive hard bargains against all parties . Obama killed Osama Bin Laden. America got what it paid for when they voted Obama.
Why change horses in the middle of the stream, especially when the other horse is heading back in the other direction? The wrong direction according to almost all Americans?
Romney knows that backwards direction leads to ruin. That is why the new Romney pushed the campaign message- minder outside the inner circle, and why Romney is now currently running for women’s rights. for the secularization of government, for the complete protection of the environment, for the elimination of greenhouse gases, and for the increase of taxes on the wealthy. That is why Romney is doing better in the polls….
Conservatism is truly dead.
When he worked for Christine O’Donnell, there were Mike Castle’s goons hiding in her bushes… When she won, they thought that was why. because she was persecuted. It was then Chris Coons goons who spent their nights hiding in Christine O’Donnell’s bushes…. When she runs in 2014, she has said that she will have her bushes sprayed prior with goon repellent….
